~ STANDARD TERMS:
-Your signed Application and Agreement Form, and receipt of a non-refundable Booking Fee/Down Payment, confirms your Ceremony/Event in our schedule.
- Any balance, along with any fees for additional services or products, is due NLT 10 days prior to the Ceremony/Event date.
- Full payment is required immediately for services booked within 14 days of the Ceremony date, and for the rental of certain private locations.
- A fee of $100 per hour applies for any additional services that are not specified in our packages, such as private consultations, touring of locations, rehearsals, pre ceremony meetings, additional photo shoot locations, etc.
- In the case of cancellation due to illness or emergency after full payment has been made, all or part of the paid balance, excluding up to 50% of the total costs, may or may not be refunded, or credited towards a future date, based upon the discretion and payment criteria of the officiant, photographer, vendors, resort/property, and/or other service providers. No refunds or credits will be issued for ceremonies and services booked or canceled within 30 days of the Ceremony date or on Valentine's Day, Christmas Eve, New Year's Eve and all Major U.S. Holidays.
- All services and products are subject to a 4.712% Hawaii General Excise Tax, including any services/products that may be added in the future.
- For Weddings or Civil Unions, ONLY, the Participants will need a Hawaii Marriage License and a State-licensed minister/officiant to perform the ceremony. It is the responsibility of the Couple to bring the Marriage License to the Ceremony.
- For all Ceremonies/Events, it is understood that at any public location, the use of that location is on a first-come/first-serve basis and that these locations cannot and will not be reserved.
- Payment for all services and products may be made in US$ by Checks; Money Orders; US$ International Bank Draft; Visa, MasterCard and Discover Cards; Bank/Credit/Debit Cards; and Cash with Credit Card Guaranty.
- It is understood that all Prices are subject to change without notice.
~ STATE
of HAWAII BEACH WEDDINGS REGULATIONS and PERMITS:
- For
Beach Location events and activities, all Participants agree to adhere to
the GENERAL TERMS AND CONDITIONS FOR COMMERCIAL ACTIVITY ON UNENCUMBERED
LAND, STATE PUBLIC BEACHES, aka Beach Permit, and affirm that they have
read these Rules and Regulations as they appear at the State of Hawaii web
page:

~ STANDARD
CONDITIONS:
- All
Ways Maui'd Weddings and/or Seventh Wave PhotoGraphics (plus all outside
service providers or sub-contractors), will not to be held responsible if
extreme weather, unexpected traffic delays or a catastrophic occurrence forces
a postponement of the event and/or a delay of the timely arrival (to the
ceremony) by the minister/officiant, photographer, members of the ceremony/event
party, sub-contractors, vendors, performers, or any other service providers
which, in turn, might impact the holding of the ceremony/event at the designated
time and place. It is understood that in some instances the event may have
to be held at your Maui accommodation, or at an adjusted time or post-poned
date.
- IF A SITUATION DEVELOPS THAT WILL SIGNIFICANTLY ALTER OR IMPACT OUR ARRANGEMENTS IN ANY WAY WHATSOEVER, IT IS FULLY YOUR RESPONSIBILITY TO NOTIFY US OF THIS AT YOUR VERY EARLIEST OPPORTUNITY. The Participants are to call Rev. Kolleen on her cell phone, 808-385-1195, if lost, late or experiencing difficulties of any kind. You may want to call the non emergency police number to check on travel delays and/or road closings, 808-986-1200, Ext 2, Option 1.
~ ADDITIONAL EXPENSES: You, the Applicants/Participants, agree to be responsible for payment of any seen or unforeseen additional costs that may incur, including but not limited to: service charges for refused checks, parking fees, transportation fees, entrance/admission fees and replacement fees for equipment breakage attributable to you or anyone in attendance with you.

ALCOHOLIC BEVERAGES and/or CONTROLLED SUBSTANCES at PUBLIC LOCATIONS:
-No Alcohol
and/or other Controlled Substances are to be brought to, or consumed at any
Public Ceremony/ Photography/ Event/ Activity before, during or after the
event. You hereby assume any and all responsibility for yourselves, your guests,
and all in attendance in this regard.
~ ALCOHOLIC BEVERAGES at PRIVATE LOCATIONS: It is understood that All Ways Maui'd Weddings and Seventh Wave PhotoGraphics will have no responsibility for any alcoholic beverages that may be served and consumed, at any time, with respect to the Ceremony/ Photography/ Event/ Celebration/ Activity; and it is further certified that no one associated with All Ways Maui'd Weddings & Ceremonies or Seventh Wave PhotoGraphics has or will have anything to do with the supplying and/or serving of any alcoholic beverages with respect to the Ceremony/ Photography/ Event/ Celebration/ Activity held at a Private Location where the consumption of alcohol is permitted by law.
~ LIABILITY
WAIVER:
- By
signing below, the Participants, hereby voluntarily indemnify, release from
liability and hold harmless Rev. Kolleen Wheeler, DBA All Ways Maui'd Weddings
& Ceremonies, and Bruce Wheeler, The Seventh Wave Emporium of Hawaii/
DBA Seventh Wave PhotoGraphics; and any and all other coordinators, location
providers, service providers, independent contractors and/or sub-contractors
contracted with the aforementioned entities (herein referred to as "the Entities")
for any accident, injury, illness, death, loss, damage to person or property,
or other consequences suffered by Participant/s or any other person arising
or resulting directly or indirectly from the Participants participation in
the Ceremony/ Photography/ Event/ Celebration or other Activity. In the event
the Participant or any Participants in the company of the primary Participants
are in any way injured, Participants agree to assume any financial obligation,
either through Participant's health insurance, or through some other means,
for any medical costs which any Participant incurs. It is the intention of
Participants by signing below to expressly assume all risk of personal injury,
death, or property damage upon him/herself, to the exclusion of the Entities
and to exempt and relieve the Entities from liability for personal injury,
property damage or wrongful death. Participants further agree that Participants,
his/her spouse, assignees, heirs, guardians, and legal representatives will
not make any claim against, sue or attach any Property of the Entities for
any loss or damage resulting from Participants or any Participant accompanying
them in the participation in the Ceremony/ Photography/ Event/ Celebration
or other Activity, that this is a release of liability, a waiver of the
Participant's legal right to collect damages in the event of injury, death
or property damage and a contract between Participants and the Entities and
Participants signs it of his/her own free will.
